ARTICLE I.
IN GENERAL
Sec. 15-1. Definitions.
The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Authorized emergency vehicle shall mean vehicles of the fire department, police vehicles and such ambulances and emergency vehicles as designated or authorized by the police chief.
Business district shall mean the territory contiguous to and including a highway when fifty (50) percent or more of the frontage thereon for a distance of three hundred (300) feet or more is occupied by buildings in use for business.
Commercial truck shall mean every truck that is used for business or commercial purposes such as pick up and delivery, and has six (6) wheels or more.
Crosswalk shall mean:
(1) That portion of a roadway ordinarily included within the prolongation or continuation of the lateral lines of sidewalks at intersections.
(2) Any portion of a roadway distinctly indicated for pedestrian crossing by lines or other markings on the surface.
Driver shall mean every person who drives or is in actual physical control of a vehicle.
Intersection shall mean the area embraced within the prolongation or continuation of the lateral side lines of two (2) highways which join one another.
Motor vehicle shall mean every vehicle which is self-propelled but not operated upon rails.
Official time standard shall mean that whenever certain hours are named herein they shall mean standard time or daylight-saving time as may be in current use in the city.
Official traffic-control devices shall mean all signs, signals, markings and devices, whether immovable or whether manually, electrically or mechanically operated, placed or erected by authority of a public body or official having jurisdiction, by which traffic is alternately directed to stop and to proceed or for the purpose of regulating, warning or guiding traffic.
Park shall mean the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading.
Pedestrian shall mean any person afoot.
Police officer shall mean every officer of the municipal police department or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations.
Private road or driveway shall mean every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons.
Right-of-way shall mean the privilege of the immediate use of the roadway.
Roadway shall mean that portion of a street improved, designed, or ordinarily used for vehicular travel.
Sidewalk shall mean that portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians.
Standing shall mean any stopping of a vehicle, whether occupied or not.
Stop, when required, shall mean the complete cessation of movement.
Stop or stopping, when prohibited, shall mean any stopping of a vehicle except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or traffic control sign or signal.
Street or highway shall mean the entire width between property lines of every way or place of whatever nature when any part thereof is open to the use of the public, as a matter of right, for purposes of traffic.
Traffic shall mean pedestrians, ridden or herded animals, vehicles and other conveyances either singly or together while using any street for purposes of travel.
Vehicle shall mean every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks.
Yield right-of-way shall mean to permit and allow the privilege of the immediate use of the roadway.

Sec. 15-2. Obedience required.
It is a violation for any person to do any act forbidden or fail to perform any act required in this chapter. Except as provided for in the state motor vehicle laws or as specifically provided for in any article or section of this chapter, any violation of this chapter shall be punishable by fine as set by state law.

Sec. 15-3. Obedience by public employees.
The provisions of this chapter shall apply to the driver of any vehicle owned by or used in the service of the United States Government, this state, county or city. It shall be unlawful for any such driver to violate any of the provisions of this chapter, except as otherwise permitted in this chapter or by state statute.

Sec. 15-4. Obedience to no-turn signs and turning markers.
Whenever authorized signs are erected indicating that no right or left or "U" turn is permitted no driver of a vehicle shall disobey the directions of any such sign, and when authorized marks, buttons, or other indications are placed within an intersection indicating the course to be travelled by vehicles turning thereat, no driver of a vehicle shall disobey the directions of such indications.

Sec. 15-5. Obedience to official traffic-control devices.
The driver of any vehicle shall obey the instructions of any official traffic-control device applicable thereto placed in accordance with the traffic ordinances of this city, unless otherwise directed by a police officer, subject to the exceptions granted the driver of an authorized emergency vehicle in this chapter.

Sec. 15-6. Necessity for signs.
No provision of this chapter for which signs are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official sign is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular section does not state that signs are required, such section shall be effective without signs being erected to give notice thereof.

Sec. 15-7. Play streets.
Whenever authorized signs are erected indicating any street or part thereof as a play street, no person shall drive a vehicle upon any such street or portion thereof except drivers of vehicles having business or whose residences are within such closed area, and then any such driver shall exercise the greatest care in driving upon any said street or portion thereof.
Emery Street adjacent to the Berlin Regional Catholic School from 7:30 a.m. to 3:30 p.m. while school is in session Emery Street - only on Emery Street, from a point where it intersects Blanchard Street, heading southerly on both sides to the intersection of Willow Street. This no parking zone is to also extend to the southerly side of Blanchard Street where it intersects Emery, for a distance of approximately twenty (20) feet in a westerly direction from this corner. This area shall be blocked off by school personnel during the above stated time to permit the described portion of Emery Street to be used as a play street.

Sec. 15-8. Limitations on turning around.
The driver of any vehicle shall not turn such vehicle so as to proceed in the opposite direction upon any street in a business district and shall not upon any other street so turn a vehicle unless such movement can be made in safety and without interfering with other traffic.

Sec. 15-9. Traffic obstruction.
No vehicle shall block a pedestrian way or intersection.

Sec. 15-10. Driving through processions.
No driver of a vehicle shall drive between the vehicles comprising a funeral or other authorized procession while they are in motion and when such vehicles are conspicuously designated as required in this chapter. This provision shall not apply at intersections where traffic is controlled by traffic- control signals or police officers.

Sec. 15-11. Permits for parades and processions.
(a) No procession or parade containing twenty-five (25) or more persons or ten (10) or more vehicles, excepting the military forces of the state and of the United States, shall occupy, march or proceed along any street except in accordance with a permit issued by the city clerk, who shall have first coordinated the activity with the police chief and fire chief. The permit shall be issued on condition that the sponsor or promoter of the procession or parade is in full compliance with RSA Chapters 105:9 or 105:9a and all other applicable provisions thereof.
(b) A permit shall be obtained from the city marshal by any person desiring to mount on a vehicle a public address system except for those persons or agencies specifically excluded in subsection (a) above.

Sec. 15-12. Funeral and other processions.
(a) A funeral composed of a procession of vehicles shall be identified as such by the display upon the outside of each vehicle of a pennant of a type in use by the funeral directors of this city.
(b) Each driver in a funeral or other procession shall drive as near to the right-hand edge of the roadway as practical and follow the vehicle ahead as close as is practical and safe.

Sec. 15-31. Traffic-control signal at the intersection of Twelfth Street and Riverside Drive.
A four-way traffic-control signal exhibiting successive green, yellow, and red colored lights shall be installed at the intersection of Twelfth Street and Riverside Drive. All traffic at such intersection shall be controlled by such traffic-control signal.

Sec. 15-32. One-way streets.
(a) Upon those streets and parts of streets described in this section, vehicular traffic shall move only in the indicated direction when signs indicating the direction of traffic are erected and maintained at every intersection where movement in the opposite direction is prohibited.
Church Street. Traffic on Church Street between School and Pleasant Streets shall be in an easterly direction from School Street to Pleasant Street.
Exchange Street. Between Pleasant Street and Main Street traffic shall be easterly only to Green Square
Glen Avenue. Traffic on Glen Avenue from the intersection of Glen Avenue and the Pleasant Street Extension, so-called, to Green Square shall be in a northerly direction.
Green Street. Between Green Square and Pleasant Street traffic shall be westerly only.
Main Street. Traffic on Main Street from Green Square to the Canadian National Railway tracks, at the intersection of Main and Pleasant Streets, shall be in a northerly direction; excepting that emergency vehicles of the police and fire departments shall be authorized to travel when responding to an emergency situation in a southerly direction on Main Street from High Street to Mason Street only.
Mechanic Street. Traffic on Mechanic Street between Main and Pleasant Streets shall be in a westerly direction from Main Street to Pleasant Street.
Pleasant Street. Traffic on Pleasant Street from the Canadian National Railway tracks, at the intersection of Main and Pleasant Streets, to the intersection of Glen Avenue and Pleasant Street Extension shall be in a southerly direction.
(b) The penalty for violating this section shall be a fine as established by state law for such violation.

Sec. 15-33. Stop intersections.
Any person operating a vehicle on a street upon which a stop sign has been placed by authority of the mayor and city council shall bring such vehicle to a complete stop before crossing the line of pedestrian traffic on such street. The following streets and squares are designated as stop streets:

Sec. 15-35. Right turn on red signal prohibited.
Vehicular traffic shall be prohibited from making a right-hand turn on a steady red traffic signal at the following described intersections, and official traffic signs so indicating shall be posted thereat:
Hillside Avenue at the north side line intersection of Willow Street
Main Street at the north and south side line intersections of Mason Street.
Mason Street at the east and west side line intersections of Main Street.
Mason Street at the east and west side line intersections of Pleasant Street.
Pleasant Street at north and south side line intersections of Mason Street.
Willow Street at the east and west side line intersections of Hillside Avenue.
Sec. 15-36. No passing zone.
(a) Lower Glen Avenue. For the purposes of this section, lower Glen Avenue shall start at the Gorham-Berlin town line and extend northerly to a point opposite to and in line with the south wall of the dwelling house at number 232 Glen Avenue.
(b) Passing prohibited. There shall be no passing of any vehicle or vehicles by the driver of any vehicle in the line of traffic moving on Glen Avenue and lower Glen Avenue.
(c) Additional lane created. Glen Avenue from the point where it intersects with Pleasant Street at its southerly terminus shall be divided into two (2) lanes. The westerly lane shall be for all traffic heading north and intending to turn onto Diana Street. The easterly lane shall be for all traffic heading north to the downtown. Said lanes shall be subject to the "no passing zone" under this section. Appropriate directional signage shall be installed.

Sec. 15-37. Truck routes.
All commercial truck traffic shall use the designated truck route from Unity Street to Coos Street and departs from Coos Street at Hutchins Street onto the designated truck route known as the east side arterial or as designated by the city manager and the police department to accommodate temporary detours. Any commercial truck, required to make a delivery or pick up in the adjoining residential neighborhoods to the truck route, is hereby exempted from this truck route solely for the purposes of pick up or delivery.
Trucks which are single axle, tandem axle, tandem axle single body, and combinations with semi trailers and all trucks having a minimum gross vehicle weight of 18,000 pounds or greater as per RSA 434:1 et seq. are to use the following truck routes which are designed to remove trucks from the hill portions of Mt. Forist Street and Third Avenue as well as the central downtown traffic corridor where possible:
(1) East bound traffic on Route 110 shall utilize either Mannering Street, if they are headed easterly or northerly, or
Madigan Street to Second Avenue to Green Street to First Avenue to Mt. Forist Street to Route 16 if they are headed
southerly on Route 16;
(2) Westerly bound traffic coming north on Route 16 shall utilize Green Street to Pleasant Street to Mt. Forist Street to
First Avenue to Green Street to Second Avenue to Madigan Street to Wight Street and Route 110 West;
(3) Westerly bound traffic coming south on Route 16 shall use High Street to Hillside Avenue to Mannering Street to
Wight Street to Route 110 westerly;
(4) North bound truck traffic on Route 16 shall use the James C. Cleveland Bridge to Unity Street and onto Hutchins
Street to the 12th Street Bridge;
(5) South bound truck traffic on Route 16 shall use the Twelfth Street Bridge to Hutchins Street to Unity Street and the
Cleveland Bridge to Route 16 South.
(6) All emergency trucks, municipal or government, as well as trucks conducting business on the restricted portions of Mt. Forist Street and Third Avenue shall be exempted from this section.
(7) Any truck in violation of this section shall be fined not less than one hundred dollars ($100.00) for each and every offense without any suspension of the fine or part thereof. It shall be prima facie evidence of a violation if any truck described above is found to be on Mt. Forist Street between First Avenue and Third Avenue and on Third Avenue from Madigan to Mt. Forist Street.

Sec. 15-38. Weight limits.
(a) The maximum allowable vehicle weights on these bridges shall be as follows:
Bridge Street, closed, pedestrian use only.
Cascade Street, seven (7) tons (except emergency vehicles with gross vehicle weights not exceeding sixteen (16) tons or sixty (60) percent of legal loads).
Cole Street, twenty (20) tons or eighty (80) percent of legal loads.
Hillside Avenue, C-2.
Hutchins Street, E-1.
Main Street, E-2.
Mason (Canal), C-2.
Mason (River), C-2.
Pleasant Street, nineteen (19) tons or seventy-five (75) percent of legal loads.
(b) The weight limits established in this section shall be posted on each bridge for which these limits apply.
(c) Any person who operates or attempts to operate any vehicle on such bridge when the weight of the load, inclusive of the vehicle, exceeds such posted limit, without a special written permit issued by the city engineer, shall be fined the sum of one hundred dollars ($100.00) for each violation, in accordance with RSA 234:41.

Secs. 15-39 Traffic Pattern Lanes
Main and Mason Street, The left lane on Main Street 50 feet back from the center of the intersection with Mason Street shall be designated Left Turn Only and marked with a sign so indicating. The right lane shall allow a right turn and thru traffic north. Overhead signs shall be erected.
Pleasant and Mason Street, The left lane on Pleasant Street 50 feet back from the center of the intersection with Mason Street shall be designated Left Turn Only and marked with a sign so indicating. The right lane shall allow a right turn and thru traffic south. Overhead signs shall be erected.
Pleasant and Green Street, The right lane on Pleasant Street 50 feet back from the center of the intersection with Green Street shall be designated, right turn only. The left lane on Pleasant Street shall allow thru traffic south. Overhead signs shall be erected. There shall be a marked “Straight Through” lane and a “Right Turn Only” lane.

Wherever authorized crossing lines are painted as depicted in Sec. 15-1, a driver of a vehicle shall yield the right of way to pedestrians per RSA 265:35.

Sec. 15-56. Designation of individual parking spaces.
The police chief is hereby authorized and directed to designate and mark such individual parking spaces as he deems proper along the streets in the parking zones hereinafter established. At each place where individual parking is so marked, each vehicle shall be parked entirely within a parking space.

Sec. 15-57. Unlawful parking.
It shall be unlawful and a violation of the provisions of this article for any person to cause, allow, permit, or suffer any vehicle registered in the name of or operated by such person to be parked beyond the period of legal parking time established for any parking zone hereinafter designated.

Sec. 15-58. Evidence.
Parking is allowed in any marked parking space in any designated parking zone for the period of time hereinafter prescribed for that zone. The police chief shall cause to be marked with chalk (or such other nonpermanent material as he shall deem appropriate), all vehicles at the interval hereinafter prescribed for that parking zone, beginning at 8:00 a.m. If any vehicle is found to be parked in the same space, as evidenced by the chalk marking, in a subsequent marking interval, such vehicle shall be deemed to be parked illegally under the provisions of this chapter. The observation by an agent of the city marshal that a vehicle has not moved from a parking space within the prescribed time period shall be prima facie evidence of the unlawful parking of such motor vehicle. If the offending vehicle is determined to be in
violation of this section in consecutive marking intervals, then each observed violation shall be deemed a separate offense and subject to a separate fine.

Sec. 15-59. Notice of violation.
It shall be the duty of the officers of the police department of the city, acting in accordance with the instructions of the police chief, to report the following information in the instance of a parking violation:
(1) The state registration number of violating vehicle.
(2) The time of the observation of such parking violation.
(3) Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation.
Each officer shall also attach to such vehicle a notice to the owner or operator thereof that such vehicle has been parked in violation of this article of this chapter.

Sec. 15-60. Presumption of liability.
For the purposes of enforcing all street traffic rules in the city, the fact that an automobile which is illegally parked is registered in the name of a person shall be considered prima facie proof that such person was in control of the automobile at the time of such parking.
